It’s official! The U.S. Attorney’s Office has decided to reopen the case of the Menéndez brothers, a move that could change the fate of Erik and Lyle Menéndez forever.

After spending 35 years in prison for the 1989 murders of their parents, José and Kitty Menéndez, the brothers will once again face the U.S. judicial system as they seek a resentencing of their case.

Los Angeles District Attorney George Gascón announced at a news conference that he will petition the court to overturn the brothers’ life sentences without the possibility of parole.

If this petition is approved, Erik and Lyle could regain their freedom in the coming weeks—a prospect that has been championed by thousands of supporters. Since the release of the Netflix series Monsters: The Story of Erik and Lyle Menéndez, many have taken to social media to demand their release.

“We are recommending that the court eliminate their life sentences without the possibility of parole and instead sentence them to 50 years to life in prison,” Gascón stated.

Why Could the Menéndez Brothers Be Released?

While the brothers’ release remains a possibility, several factors could qualify Erik and Lyle for immediate parole.

First, the defense claims to have new evidence supporting the allegations of physical, sexual, and emotional abuse that both brothers endured for years at the hands of their father.

These claims have gained credibility following Roy Roselló, a former member of the band Menudo, coming forward in the documentary Menéndez + Menudo: Boys Betrayed with allegations that José Menéndez abused him in the 1980s.

Additionally, California law allows for the reconsideration of sentences for individuals who were under 26 at the time of the crime, have served many years in prison, and can demonstrate rehabilitation. Erik and Lyle, who were in their early 20s when the murders occurred, may now qualify for parole under this provision.

However, it is important to note that this reevaluation does not excuse or justify their actions. Rather, it sheds new light on the case, giving greater weight to the allegations of sexual abuse that the brothers have long claimed played a role in their crime.

“There is no excuse for their crime, but certain conditions could have contributed to the situation,” Gascón explained. “They have shown, through both actions and words, their commitment to rehabilitation, even when they believed they would never be released.”
