Last Wednesday, a lawsuit against actor Jamie Foxx was filed in New York. The suit filed by “Jane Doe,” accused the Oscar-winning actor of allegedly assaulting her at a New York Rooftop in 2015.

According to the legal document, Jamie Foxx groped the woman’s breasts and stuck his hand inside her pants, while a security guard was witnessing. The woman wants compensation for the emotional distress and anxiety derived from the alleged incident and claims she required medical and psychological attention afterward.

Although Jamie Foxx hasn’t said anything himself, a spokesperson of the actor has replied to the accusations deeming them a “frivolous action.” Besides denying this ever happened, the unnamed spokesperson clarified that this person had already filed a “nearly identical” lawsuit in Brooklyn and that the case was shortly dismissed

Foxx’s rep claims that the accusation has never been viable and won’t be this time“We’re confident they will be dismissed again.” Although the lawsuit describes in detail what allegedly happened, the spokesperson says that once this new suit is dismissed“Mr. Foxx intends to pursue a claim for malicious prosecution against this person and her attorneys for re-filing this frivolous action.”

Jane Doe, who didn’t want to use her real name in the suit, managed to accuse Eric Marlon Bishop (Jamie Foxx’s real name) thanks to New York’s Adult Survivors Act. This gave plaintiffs one year to file civil claims for sexual assault. This window closes this Thursday, which is why the suit was successfully filed yesterday despite the wave of assault lawsuits that arrived these past few days.
