Ugandan Constitutional Court endorses the anti-LGTBI law that contemplates the death penalty

The Ugandan Parliament had passed the Anti-Homosexuality Act in March 2023, criminalizing consensual same-sex conduct with penalties of up to life imprisonment, attempted homosexual acts with penalties of 10 years in prison, and the death penalty for those convicted of “aggravated homosexuality.”

This term also includes repeated same sex acts and intercourse with a person younger than 18, older than 75, or a person with a disability and people in an unconscious state who cannot give consent.

According to a statement from the Constitutional Court released by the Government, “The Anti-Homosexuality Act is a reflection of the socio-cultural realities of Ugandan society and was passed by an overwhelming majority of democratically elected representatives of the citizens.”

“We are going to implement the law to make sure that homosexuals have no place in Uganda,”  Musa Ecweru, minister in Uganda said during the approval debate, which was attended by applause and chants.

The judges assert that it is necessary to preserve a balance between the interests of society and individual autonomy, which is why they annulled four of the provisions contemplated in the law, specifically, for example, those that criminalize the transfer of facilities for “homosexual purposes.”

Yoweri Museveni, Uganda’s president, signed the law into law in May last year. Human rights organizations saw this event as a setback for the LGBTIQ+ community. This law led to a review of the funds by the World Bank.

In the past decade, 17 countries have stopped prosecuting homosexuality, including Antigua and Barbuda, St. Kitts and Nevis, Angola, Mozambique, Singapore and most recently, Barbados, but there are still countries all around the world that penalizes homosexuality.
