Special Counsel Jack Smith has filed to dismiss all federal charges against President-elect Donald Trump. These charges, which stemmed from Trump’s handling of classified documents and efforts to overturn the 2020 election results, marked unprecedented legal challenges for a former U.S. president.

Trump, who was indicted twice on federal charges in 2023, had pleaded not guilty and maintained that the prosecutions were politically motivated. His reelection as president in 2024 complicates these cases, as longstanding Department of Justice policy prohibits prosecuting a sitting president.

The first indictment, issued in June 2023, accused Trump of 37 felony counts related to his alleged mishandling of classified documents at his Mar-a-Lago residence. Charges included willful retention of national defense information and obstruction of justice. A Florida judge dismissed the case, though Smith’s office sought an appeal.

In August 2023, Trump faced a second indictment for four felonies tied to his alleged efforts to overturn the 2020 election. These included conspiracy to defraud the United States and conspiracy to obstruct an official proceeding—the latter related to the January 6 Capitol attack.

Why the Charges Were Dropped

Smith’s decision to drop the charges reflects the Justice Department’s policy that sitting presidents cannot be prosecuted. This doctrine, established during the Watergate era, is designed to prevent legal cases from interfering with a president’s ability to perform their duties.

“The Government’s position on the merits of the defendant’s prosecution has not changed,” Smith stated in the filing. “But the circumstances have.”

Smith’s filing also noted the tension between two national priorities: the rule of law and the Constitution’s protection of the presidency. Ultimately, Trump’s reelection and the protections it grants as a sitting president rendered the cases moot.

But the dismissal of Trump’s cases follows significant legal and procedural challenges. A key moment came when conservative judges on the Supreme Court expanded presidential immunity, ruling that interactions between a president and the attorney general are “absolutely immune” from prosecution.

Additionally, federal judge Aileen Cannon, appointed by Trump, dismissed the classified documents case, citing issues with Smith’s appointment as special counsel—a decision criticized by legal experts but upheld in court.

Of course, Trump has framed the dropped charges as vindication, with his spokesperson Steven Cheung declaring it a “major victory for the rule of law” and calling for an end to what Trump has described as “political weaponization” of the justice system.

However, Smith’s resignation and the decision to drop charges don’t erase the broader implications of Trump’s legal challenges. His reelection, despite the controversies, underscores deep political divisions in the U.S.

The Capitol attack remains a pivotal moment in Trump’s presidency and reelection campaign. Many rioters convicted for their roles on January 6 have expressed regret, calling themselves “gullible” for believing Trump’s baseless election fraud claims.

The Justice Department has vowed to continue pursuing key offenders involved in the Capitol violence, even as Trump has promised to pardon certain rioters he views as “political prisoners.” His inauguration route, which includes the site of some of the worst violence on January 6, serves as a symbolic backdrop for his return to office.

The dismissal of federal charges against Trump marks a historic and polarizing moment in American politics. For his supporters, it’s a victory against what they view as a politically motivated justice system. For others, it raises concerns about accountability and the precedent set for future leaders.
