The United States Department of Justice, along with over ten states, filed a landmark lawsuit against Apple on Thursday, accusing the tech giant of illegally monopolizing the smartphone market. This is the latest in a series of antitrust lawsuits brought against big tech companies by the US government, which is cracking down on the unchecked power of the massive industry.
“Apple has maintained monopoly power in the smartphone market not only by outpacing competition on the merits but also by violating federal antitrust law. Consumers should not have to pay higher prices because companies violate the law,” said Attorney General Merrick Garland.
Why are they suing Apple?
The lawsuit alleges that Apple is violating the law by carefully curating its app store and customer experience to attract and retain customers, excluding competitors. In response, Apple stated it disagreed with the lawsuit and would vigorously fight it, claiming it threatened its identity and the principles that distinguish Apple products in fiercely competitive markets. If successful, the lawsuit could compel Apple to relax some of the restrictions it has imposed in its restrictive approach to hardware and software. For example, it could be forced to allow the existence of alternative app stores on its iPhone and open its technologies like iMessage to Android phones.

Furthermore, Apple’s practices extend to product functionalities, where iPhones have better access and features than competitors’ products, creating a disparity. The company’s products also have access to certain hardware capabilities that are restricted from other companies, resulting in a different user experience.
