Dan Schneider, the well-known showrunner behind some of Nickelodeon’s biggest hits, just got the green light to continue his defamation lawsuit over the documentary Quiet on Set. The film explored allegations of sexual misconduct at Nickelodeon, and Schneider claims it unfairly painted him as either a sexual abuser or someone who knowingly hired predators for his shows.

Judge Allows Dan Schneider To Proceed with a Defamation Lawsuit

In a ruling on Friday, Judge Ashfaq G. Chowdhury found Schneider’s claims were solid enough to move forward. The judge noted that a “reasonable viewer” could take the documentary as making “damning implications” about Schneider’s behavior.

Schneider’s suit targets Warner Bros. and Sony, which produced and distributed the documentary. They had tried to get the case dismissed under California’s anti-SLAPP law—a statute meant to protect free speech on public issues from being stifled by lawsuits. Their argument? The documentary never outright accused Schneider of abuse.

But according to the judge, Schneider’s lawyers made a strong case that defamation doesn’t have to be explicit. The documentary, along with its trailer, allegedly implies Schneider engaged in sexual misconduct or was complicit in others’ abuse.

Released in March, Quiet on Set: The Dark Side of Kids TV dives into claims about toxic and inappropriate behavior in children’s programming. It references a 2022 Business Insider article that accused Schneider of creating a controlling and uncomfortable work environment. While no evidence of sexual misconduct was found during Nickelodeon’s internal investigation in 2018, the network did part ways with Schneider over allegations of verbal abuse.

The documentary also highlighted two former Nickelodeon staffers, Brian Peck and Jason Handy, both of whom were later convicted of child sex abuse. Schneider argues that the series unfairly links him to these individuals, creating what his legal team calls a “defamatory implication.”

Is Schneider Guilty?

Schneider has repeatedly denied any allegations of sexual abuse. He has, however, apologized for certain behaviors on set, like his temper and requesting neck massages from colleagues.

Initially, the judge leaned toward dismissing the case, saying Schneider hadn’t provided enough evidence to prove the documentary’s claims were false. But Schneider’s team countered with a sworn statement from the showrunner himself, where he declared:

“I have never sexually assaulted or sexually abused a child. Any statement or implication that I did so is false, and I will testify at trial to that.”

That declaration was enough to keep the lawsuit alive, with the case now heading to the next phase.
