The federal judge presiding over the classified documents charges against former President Donald Trump has dismissed the indictment. The dismissal was based on the argument that special counsel Jack Smith was improperly appointed, as detailed in a court filing on Monday.

U.S. District Judge Aileen M. Cannon‘s ruling marks a significant legal victory for Trump. His legal team had previously tried various arguments to dismiss the case, but similar attempts in other courts had failed. The Justice Department is expected to appeal the decision, potentially taking the legal battle to the Supreme Court.

Even if the ruling is overturned, the dismissal contributes to a series of legal wins for Trump, including a recent Supreme Court ruling that grants former presidents broad immunity for their official acts. Trump’s legal team viewed the classified documents case as the strongest among the four criminal cases against him, primarily because the actions in question occurred after he left office.

Trump faced 40 counts of illegally retaining classified defense information and obstructing efforts to retrieve the material. Some documents found during an FBI search of Mar-a-Lago contained highly sensitive information. Cannon’s decision comes as Trump prepares for the Republican National Convention, where he is expected to be formally nominated as the party’s presidential candidate.

Previously, Trump was convicted in May of falsifying records related to a hush money payment, but he is challenging that verdict based on the Supreme Court’s immunity ruling. Two other cases against him—one federal election interference case in D.C. and a state trial in Georgia—have been stalled by legal challenges and are also affected by the immunity decision.

In her 93-page ruling, Cannon noted that the issue of a special counsel was novel and had to be resolved before prosecution could proceed. She concluded that Smith’s prosecution breached key constitutional principles regarding the appointment of officers and the authorization of expenditures by Congress.

The argument that Smith was illegally appointed gained traction after Supreme Court Justice Clarence Thomas wrote that the special counsel’s office should be established by Congress and confirmed by the Senate. Although Trump’s legal team did not initially adopt this argument, conservative legal groups pushed for its inclusion in court.

Cannon’s ruling does not apply to other jurisdictions, meaning it does not affect Smith’s oversight of the election interference case against Trump. However, the decision has been met with mixed reactions. Some view it as a justified adherence to constitutional principles, while others see it as a favorable ruling for Trump, raising concerns about judicial impartiality.

The dismissal can be appealed, and other district judges and the D.C. Circuit have upheld the constitutionality of special counsels in previous challenges. If overturned, Smith might seek to have Cannon removed from the case due to her pattern of rulings favorable to Trump.
