In May 2023, the Menendez brothers’ legal team filed a habeas petition, presenting newly discovered evidence that was not available during the original trials.

This evidence includes a letter written by Erik Menendez to his cousin, Andy Cano, a year before the murders, detailing the alleged abuse by their father. This letter, discovered by journalist Robert Rand, has been described as a critical element in their appeal.

Erik Menendez’s daughter, Talia, has been actively advocating for her father’s release, using her Instagram account to share updates on the case. She recently revealed that a decision on Menendez brothers appeal for freedom is expected within the next 60 days.

The appeal is being considered by the Los Angeles County District Attorney’s office, which is reviewing the new evidence.

According to Talia Menendez, there are several possible outcomes for the appeal:

  1. Time Served: The brothers could be released immediately.
  2. Additional Prison Time: They might serve an additional 3-5 years.
  3. Parole Board Review: The case could be referred to the parole board, which might become a political issue.
  4. No Change: The life sentences could remain unchanged.

The case has garnered significant public attention over the years, with divided opinions on the brothers’ guilt and the potential for a new outcome. The release of Ryan Murphy’s Netflix series, “Monsters: The Lyle and Erik Menendez Story,” has further fueled discussions about the case.

This renewed interest has brought the brothers’ story back into the spotlight, highlighting the complexities of their situation and the justice system. In fact, Ryan Murphy made some controversial statements about it saying that he believes that this increased visibility is beneficial for the brothers, as it has sparked public interest and discussions about their situation and the justice system.

“The best thing that has happened to the Menendez brothers in 30 years.” He continues, “They are now being talked about by millions of people all over the world. There’s a documentary coming out into two weeks about them, also on Netflix. And I think the interesting thing about it is it’s asking people to answer the questions, ‘Should they get a new trial? Should they be let out of jail? What happens in our society? Should people be locked away for life? Is there no chance ever at rehabilitation?’ I’m interested in that, and a lot of people are talking about it,” said Murphy about Menendez brothers.
